Sacking an employee is a serious matter and one that should not be taken lightly. As such, it's important to ensure that proper steps are taken. There are both legal and procedural requirements to follow in order for the process to remain compliant with the law. When sacking an employee, you must first determine a valid reason for dismissal. Grounds could include capability or qualifications-related issues, misconduct or some other substantial reason related to the job role. You must also carry out a fair procedure before making the decision - this includes investigating any relevant facts of misconduct or substandard performance, as well as giving the employee notice of dismissal and an opportunity to defend him/herself. It’s also essential that any disciplinary process or warnings prior to dismissal are documented and that the employee is given every chance to improve performance.
